GoPlugSmart is operated by GoPlugSmart Technologies Private Limited, a company registered in India with its principal place of business at Gwalior, Madhya Pradesh ("Company", "we", "us", or "our").

GoPlugSmart provides a comprehensive smart electric vehicle (EV) charging platform including the following services:
2.1 Mobile Application Services
- Real-time EV charging station locator: Find nearby charging stations displayed on an interactive map with live availability indicators.
- Charger information: View connector types (including CCS, Type 2, and other standard connectors), power ratings, manufacturer details, and user ratings.
- Smart trip planning: Route mapping with strategically placed charging stops, real-time availability updates, and smart pop-up notifications as you approach charging stations.
- Amenities information: View nearby amenities at or around charging stations.
2.2 Informational Services
- Blog articles, guides, and educational content on EV technology, charging infrastructure, and sustainable mobility.
- Newsletter subscription for updates on EV charging technology, installations, and company news.
GoPlugSmart reserves the right to modify, suspend, or discontinue any aspect of the Platform or its services at any time, with or without notice, and without liability to you.
3. Eligibility and Account Registration
3.1 Eligibility
To use the Platform, you must:
- Be at least 18 years of age, or the age of majority in your jurisdiction.
- Possess the legal capacity to enter into a binding contract under Indian law.
- Not be barred from using the Platform under any applicable law or regulation.
- Own, operate, or have lawful access to an electric vehicle, or have a legitimate professional or commercial interest in EV charging infrastructure.
3.2 Account Registration
Certain features of the App and Platform may require you to create a user account. When registering, you agree to:
- Provide accurate, current, and complete information as prompted.
- Maintain and promptly update your account information to keep it accurate and complete.
- Keep your login credentials confidential and not share them with any third party.
- Accept responsibility for all activity that occurs under your account.
- Notify us immediately at support@goplugsmart.com if you suspect any unauthorized access to or use of your account.
GoPlugSmart reserves the right to suspend or terminate any account at its sole discretion if it determines that any information provided is inaccurate, false, or violates these Terms.
4. Use of the Platform
4.1 Permitted Use
You may use the Platform solely for lawful, personal, and commercial purposes consistent with these Terms. Permitted uses include locating charging stations, planning EV trips, and accessing educational content.
4.2 Prohibited Conduct
You agree that you shall not:
- Use the Platform for any unlawful, fraudulent, deceptive, or harmful purpose.
- Attempt to gain unauthorized access to any part of the Platform, its servers, databases, or connected systems.
- Reverse engineer, decompile, disassemble, or attempt to extract source code from any part of the App or Platform.
- Transmit malware, viruses, ransomware, spyware, or any other malicious code.
- Interfere with, damage, or disrupt the integrity, security, or performance of the Platform.
- Use automated scripts, bots, crawlers, or data-scraping tools on the Platform without prior written consent.
- Engage in any conduct that could harm GoPlugSmart's reputation, business, or relationships with third parties.
- Post, submit, or transmit any false, misleading, defamatory, or infringing content.
- Impersonate GoPlugSmart, its employees, or any other person or entity.
- Use the Platform to collect personal information of other users without their consent.
- Attempt to bypass any security measures, access controls, or authentication systems.
- Use the Platform to facilitate any transaction involving illegal goods or services.
5. Intellectual Property
5.1 GoPlugSmart Content
All content, features, and materials available through the Platform — including the GoPlugSmart name, logo, App interface, website design, text, graphics, images, blog content, and underlying software — are the exclusive property of GoPlugSmart and are protected by Indian and international intellectual property laws including the Copyright Act, 1957 (India) and the Trade Marks Act, 1999 (India).
5.2 License to Users
GoPlugSmart grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purposes in accordance with these Terms. This license does not permit you to:
- Reproduce, republish, or commercially exploit any content from the Platform without written permission.
- Modify, create derivative works from, or translate any Platform content.
- Sub-license, sell, or transfer your license to any third party.
5.3 User-Generated Content
If you submit reviews, feedback, ratings, or other content through the Platform, you grant GoPlugSmart a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and publish such content for any business purpose. You represent that you own or have all necessary rights to such content and that it does not infringe any third-party rights.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOPLUGSMART, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of data, revenue, profits, business opportunities, or goodwill.
- Vehicle damage or personal injury arising from reliance on Platform data or use of third-party charging infrastructure.
- Service interruptions, data loss, or App downtime.
- Inaccuracies in charging station availability, location, or compatibility data.
7. Indemnification
You agree to indemnify, defend, and hold harmless GoPlugSmart and its officers, directors, employees, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Platform in violation of these Terms.
- Your violation of any applicable law or regulation.
- Your infringement of any intellectual property or other rights of any third party.
- Any content you submit, post, or transmit through the Platform.
- Any unauthorized use of your account.
8. Governing Law and Dispute Resolution
8.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Indian Contract Act, 1872, and all other applicable Indian legislation.
8.2 Jurisdiction
Any disputes arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Gwalior, Madhya Pradesh, India.
8.3 Dispute Resolution
Before initiating any formal legal proceedings, we encourage users to contact GoPlugSmart at support@goplugsmart.com to attempt to resolve disputes amicably. GoPlugSmart will make reasonable efforts to address and resolve complaints within 90 days.
8.4 Consumer Rights
Nothing in these Terms limits or excludes any rights you have as a consumer under the Consumer Protection Act, 2019 (India) or any other applicable mandatory consumer protection legislation.
9. Force Majeure
GoPlugSmart shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond its reasonable control, including acts of God, natural disasters, government actions, power outages, cyberattacks, telecommunications failures, or other force majeure events.
10. Modifications to Terms
GoPlugSmart reserves the right to update or modify these Terms at any time. Amended Terms will be posted on the Website and, where practicable, communicated via email. Your continued use of the Platform following the posting of changes constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.
11. Severability and Entire Agreement
If any provision of these Terms is found to be unlawful, void, or unenforceable, it shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions. These Terms, together with the Privacy Policy, constitute the entire agreement between you and GoPlugSmart concerning your use of the Platform and supersede all prior agreements.
12. Third Party Services
Third-party services accessible via or integrated with our Platform are governed by their own terms and privacy policies. GoPlugSmart is not responsible for third-party practices.
13. Electronic Acceptance
By clicking "I Agree", registering an account, downloading the App, or continuing to use the Platform, the user agrees that such electronic acceptance constitutes a legally binding agreement under the Information Technology Act, 2000.
